{"id":3669,"date":"2021-03-25T11:19:16","date_gmt":"2021-03-25T11:19:16","guid":{"rendered":"https:\/\/cvinoticias.com\/v3\/?p=3669"},"modified":"2021-03-25T11:21:58","modified_gmt":"2021-03-25T11:21:58","slug":"derogaron-el-voto-por-correo-postal-para-los-argentinos-en-el-exterior","status":"publish","type":"post","link":"https:\/\/cvinoticias.com\/v3\/derogaron-el-voto-por-correo-postal-para-los-argentinos-en-el-exterior\/","title":{"rendered":"Derogaron el voto por correo postal para los argentinos en el exterior"},"content":{"rendered":"\n<p><strong><em>El Gobierno nacional derog\u00f3 un decreto firmado por el expresidente Mauricio Macri por no tener \u00abla debida intervenci\u00f3n del Congreso ni legislaci\u00f3n alguna que habilite reglamentar esta modalidad\u00bb de sufragio.<\/em><\/strong><\/p>\n\n\n\n<p>El Gobierno nacional derog\u00f3 un decreto firmado por el expresidente Mauricio Macri que permit\u00eda la votaci\u00f3n de argentinos residentes en el exterior por correo postal\u00a0por no tener \u201cla debida intervenci\u00f3n del Congreso ni legislaci\u00f3n alguna que habilite reglamentar esta modalidad\u201d de sufragio.<\/p>\n\n\n\n<p>La derogaci\u00f3n del decreto 45, fechado el 11 de enero de 2019, se efectiviz\u00f3 mediante el\u00a0decreto 189\/2021 publicado en el Bolet\u00edn Oficial, que lleva las firmas del presidente Alberto Fern\u00e1ndez; del jefe de Gabinete, Santiago Cafiero; y del ministro del interior, Eduardo \u2018Wado\u2019 de Pedro.<\/p>\n\n\n\n<p>El decreto publicado este martes se suma al del pasado 12 de marzo que derog\u00f3 otras normas dictadas por Macri en relaci\u00f3n a los comicios: las que permit\u00edan el voto anticipado de las personas privadas de libertad y de los miembros de las fuerzas armadas y de seguridad afectadas al operativo electoral.<\/p>\n\n\n\n<p>Al anticipar la derogaci\u00f3n de las tres modalidades, la secretaria de Asuntos Pol\u00edticos del Ministerio del Interior, Patricia Garc\u00eda Blanco, hab\u00eda explicado d\u00edas atr\u00e1s a trav\u00e9s de un comunicado: \u201cLa Constituci\u00f3n Nacional es clara, un decreto no puede modificar una ley y menos en materia electoral. Cualquier propuesta vinculada a los cambios de fecha o metodolog\u00edas de votaci\u00f3n debe pasar por el Congreso de la Naci\u00f3n y ser respaldada por una mayor\u00eda especial de votos\u201d.<\/p>\n\n\n\n<p>Los decretos firmados por Macri en 2019 habilitaban el sufragio universal \u201cde manera anticipada en o v\u00eda postal, pese a que esas modalidades no est\u00e1n contemplada la ley electoral\u201d, remarcaron los voceros de la cartera de Interior.<\/p>\n\n\n\n<p>En el decreto publicado, las autoridades recuerdan que pese a la creaci\u00f3n por ley del Registro de Electores Residentes en el Exterior con el fin de que los ciudadanos puedan participar en las elecciones nacionales desde los pa\u00edses en donde habitan, \u201cel Decreto N\u00b0 45\/19 introdujo modificaciones en la reglamentaci\u00f3n, implementando un sistema de votaci\u00f3n por correo postal como forma opcional de ejercer el derecho al sufragio\u201d.<\/p>\n\n\n\n<p>Esto \u201cconllev\u00f3 la creaci\u00f3n de una nueva modalidad o sistema de votaci\u00f3n que no se encontraba previsto en la legislaci\u00f3n electoral aprobada por el Congreso\u201d, destaca la normativa.<\/p>\n\n\n\n<p>A\u00f1ade que \u201d como consecuencia de ello, para llevar adelante el acto eleccionario el entonces titular del Poder Ejecutivo determin\u00f3 en forma unilateral y por v\u00eda reglamentaria, aspectos vinculados a la conformaci\u00f3n de padrones de electores y electoras por correo postal, utilizaci\u00f3n de sobres electorales, procedimientos para la emisi\u00f3n del sufragio y posterior escrutinio, entre otras regulaciones introducidas a trav\u00e9s del Decreto N\u00b0 45\/19\u2033.<\/p>\n\n\n\n<p>Todo esto se produjo \u201csin la debida intervenci\u00f3n del Congreso ni legislaci\u00f3n alguna que habilite reglamentar esta modalidad de votaci\u00f3n\u201d, aclara el decreto publicado hoy.<\/p>\n\n\n\n<p>Adem\u00e1s, sostiene que \u201cel art\u00edculo 86 del C\u00f3digo Electoral Nacional estipula que los electores y las electoras pueden votar \u00fanicamente en la mesa receptora de votos en cuya lista figuren asentados y asentadas, debiendo el presidente o la presidenta de la mesa verificar si el elector o la electora a quien pertenece el documento c\u00edvico figura en el padr\u00f3n electoral de la mesa\u201d.<\/p>\n\n\n\n<p>Esta circunstancia se realiza indistintamente en las mesas electorales de residentes en el pa\u00eds o en aquellas del exterior.<\/p>\n\n\n\n<p>Asimismo, se remarca que la Constituci\u00f3n Nacional \u201cen su art\u00edculo 77 fij\u00f3 un r\u00e9gimen de mayor\u00edas especiales en lo atinente a los proyectos de ley que modifiquen el r\u00e9gimen electoral o de los partidos pol\u00edticos, con el fin de dotar de mayor estabilidad a las reglas del proceso democr\u00e1tico y de la competencia electoral\u201d.<\/p>\n\n\n\n<p>\u201cEl art\u00edculo 99, inciso 3 de la Carta Magna ved\u00f3 en forma absoluta e insanable al Poder Ejecutivo emitir disposiciones de car\u00e1cter legislativo, referidas a materias que regulen el r\u00e9gimen electoral, entre otras, aun cuando se presentasen las circunstancias excepcionales que hicieran imposible seguir los tr\u00e1mites ordinarios previstos para la sanci\u00f3n de las leyes y se requiriere la emisi\u00f3n de un decreto por razones de necesidad y urgencia\u201d, indica.<\/p>\n\n\n\n<p>Por otra parte, el art\u00edculo 5\u00b0 de la Ley N\u00b0 24.007 que faculta al PE a su reglamentaci\u00f3n, \u201cno prev\u00e9 la incorporaci\u00f3n de una modalidad de votaci\u00f3n distinta a la existente, como es el caso del voto por correo, no reconocido ni regulado en la normativa electoral vigente\u201d.<\/p>\n\n\n\n<p>En este sentido, impugnada la constitucionalidad del decreto 45\/19 ante el fuero electoral y llegado el caso a instancias del M\u00e1ximo Tribunal, el 3 de marzo de 2021, la procuradora fiscal ante la Corte afirm\u00f3 que la norma \u201cimplementa un sistema de votaci\u00f3n que resulta incompatible con los criterios fijados por normas de jerarqu\u00eda superior que regulan la materia electoral\u201d, entre otras consideraciones, y resalta que la deliberaci\u00f3n debe darse \u201cen el \u00e1mbito del Poder Legislativo\u201d.<\/p>\n\n\n\n<p>Fuente:&nbsp;T\u00e9lam<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El Gobierno nacional derog\u00f3 un decreto firmado por el expresidente Mauricio Macri por no tener \u00abla debida intervenci\u00f3n del Congreso ni legislaci\u00f3n alguna que habilite reglamentar esta modalidad\u00bb de sufragio.
