{"id":15767,"date":"2022-05-16T12:30:09","date_gmt":"2022-05-16T12:30:09","guid":{"rendered":"https:\/\/cvinoticias.com\/v3\/?p=15767"},"modified":"2022-05-16T12:30:09","modified_gmt":"2022-05-16T12:30:09","slug":"el-ejercito-debera-entregarle-tierras-del-estado-a-los-mapuches-por-un-fallo-judicial","status":"publish","type":"post","link":"https:\/\/cvinoticias.com\/v3\/el-ejercito-debera-entregarle-tierras-del-estado-a-los-mapuches-por-un-fallo-judicial\/","title":{"rendered":"El Ej\u00e9rcito deber\u00e1 entregarle tierras del Estado a los mapuches por un fallo judicial"},"content":{"rendered":"\n<p><strong><em>La C\u00e1mara de Apelaciones de General Roca desestim\u00f3 un recurso y dej\u00f3 firme una sentencia que obliga a ceder 180 hect\u00e1reas ubicadas a pocos kil\u00f3metros de Bariloche.<\/em><\/strong><\/p>\n\n\n\n<p>El Ej\u00e9rcito Argentino, a trav\u00e9s del Ministerio de Defensa, apel\u00f3 fuera de t\u00e9rmino un fallo judicial que dispon\u00eda la entrega del t\u00edtulo de propiedad de 180 hect\u00e1reas del Estado Nacional a una comunidad mapuche de Bariloche, y la C\u00e1mara de Apelaciones de General Roca desestim\u00f3 el recurso presentado.<\/p>\n\n\n\n<p>El organismo nacional intent\u00f3 revertir el fallo de la jueza federal subrogante Silvina Dom\u00ednguez, que establec\u00eda la transferencia inmediata a la comunidad, previo otorgamiento al Instituto Nacional de Asuntos Ind\u00edgenas (INAI) para su posterior adjudicaci\u00f3n a comunidad Millalonco Ranquehue. Ahora recurrir\u00e1 a la Corte.<\/p>\n\n\n\n<p>El espacio en litigio est\u00e1 ubicado a 12 kil\u00f3metros de Bariloche, en el coraz\u00f3n de un amplio territorio que pertenece a la instituci\u00f3n castrense.<\/p>\n\n\n\n<p>La C\u00e1mara que desestim\u00f3 el planteo estatal, integrada por los jueces Mariano Roberto Lozano y Richar Fernando Gallego, menciona que la sentencia impugnada fue notificada el 2 de febrero a las 12:11 y el recurso presentado el 6 de febrero a las 20:25, cuando hab\u00eda expirado el plazo para poder hacerlo.<\/p>\n\n\n\n<p>Sin embargo, Dom\u00ednguez hizo lugar al planteo y elev\u00f3 el expediente a la entidad que se ocup\u00f3 de desestimarlo por \u201cextempor\u00e1neo\u201d.<\/p>\n\n\n\n<p>El abogado de la comunidad originaria, Mat\u00edas Schraer, hab\u00eda anticipado que el recurso planteado por el Estado fue presentado fuera de t\u00e9rmino.<\/p>\n\n\n\n<p>Las familias Millalonco Ranquehue aseguran que sostienen la ocupaci\u00f3n tradicional de las tierras desde fines del siglo XIX, incluso \u201cdesde antes de la instalaci\u00f3n de las tropas militares\u201d. El territorio se mantiene bajo custodia del Estado desde 1937.<\/p>\n\n\n\n<p>El fallo de Dom\u00ednguez gener\u00f3 cr\u00edticas \u201cpor el antecedente\u201d, que podr\u00eda dar lugar a otros reclamos similares.<\/p>\n\n\n\n<p>El abogado local Diego Breide, integrante de la Mesa de Consenso, admiti\u00f3 su preocupaci\u00f3n por dicha sentencia ya que \u201cotras comunidades ir\u00e1n tras los mismos pasos, atentando entre otras cosas con el emplazamiento del Parque Central\u201d.<\/p>\n\n\n\n<p>En ese entonces, Breide admiti\u00f3 que \u201cla jueza ya demostr\u00f3 cu\u00e1les son sus simpat\u00edas\u201d. Adem\u00e1s, mencion\u00f3 otra pol\u00e9mica resoluci\u00f3n de la magistrada de absolver a Mar\u00eda Nahuel, una referente mapuche que en pleno juicio agredi\u00f3 a la fiscal federal Sylvia Little. Tras esa pol\u00e9mica, la funcionaria judicial present\u00f3 su dimisi\u00f3n al cargo aunque luego fue ratificada en el mismo, cuando recibi\u00f3 el acompa\u00f1amiento de la Procuradur\u00eda General de la Naci\u00f3n. \u201cEst\u00e1 claro cu\u00e1l es su ideolog\u00eda\u201d, sentenci\u00f3 el abogado.<\/p>\n\n\n\n<p>Adem\u00e1s de ese y otros cuestionamientos de empresarios locales, instituciones y organismos, diputados de la oposici\u00f3n fueron cr\u00edticos con el fallo y pidieron que se dicte su nulidad.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large is-resized\"><a href=\"https:\/\/cvinoticias.com\/wp-content\/uploads\/2022\/05\/ISPREZXCRFG5DAMIIRYEI5HJ3Y.jpg\"><img decoding=\"async\" data-src=\"https:\/\/cvinoticias.com\/wp-content\/uploads\/2022\/05\/ISPREZXCRFG5DAMIIRYEI5HJ3Y-768x1024.jpg\" alt=\"\" class=\"wp-image-15769 lazyload\" width=\"700\" height=\"932\" data-srcset=\"https:\/\/cvinoticias.com\/wp-content\/uploads\/2022\/05\/ISPREZXCRFG5DAMIIRYEI5HJ3Y-768x1024.jpg 768w, https:\/\/cvinoticias.com\/wp-content\/uploads\/2022\/05\/ISPREZXCRFG5DAMIIRYEI5HJ3Y-225x300.jpg 225w\" data-sizes=\"(max-width: 700px) 100vw, 700px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 700px; --smush-placeholder-aspect-ratio: 700\/932;\" \/><\/a><\/figure>\n\n\n\n<p>A trav\u00e9s de un proyecto de resoluci\u00f3n que present\u00f3 el parlamentario Alberto Asseff, y que fue acompa\u00f1ado por Gerardo Cipolini, Francisco S\u00e1nchez, H\u00e9ctor Stefani, Pablo Torello, Alfredo Schiavoni, Virginia Cornejo, Gustavo Hein y Jos\u00e9 N\u00fa\u00f1ez, entre otros, manifestaron su \u201cprofundo desagrado y preocupaci\u00f3n\u201d respecto al fallo judicial.<\/p>\n\n\n\n<p>En sus fundamentos plantearon que era ileg\u00edtimo el otorgamiento de las tierras debido a que \u201cno se ha dado debida intervenci\u00f3n a la provincia de R\u00edo Negro, en su calidad de tercera necesaria\u201d.
